√    Has had no more than one prior conviction to a DUI/DWI related charge, but, due to the passage of time, that conviction can no longer serve as a “Prior DUI/DWI” for sentence enhancing purposes, and

√    Has never been convicted of, plead guilty to, or entered a plea of no contest to a charged of:

–  Aggravated DUI/DWI (Property Damage or Injury to another person), or

–  Extreme or Super-extreme DUI/DWI, and

√    Has never been convicted of, plead guilty to or entered a plea of no contest to the offense of driving on a suspended license while on DUI/DWI probation, then:
